A recent joint inspection operations involving the Hawks, Department of Labour, Home Affairs, and Officials from the Bargaining Council raided two well known restaurants in Pretoria on 15 September 2024 whereby several issues regarding non-compliance was discovered and revealed major labour law violations

  • Over R1.3 million in underpaid wages. These businesses were found to be non-compliant with the National Minimum Wage Act; 
  • Violation of other crucial labour legislation, including basic working conditions as prescribed by the Basic Conditions of Employment Act and Main Agreement,  
  • Employment of foreign nationals without the necessary documentation; 
  • Non-Compliance with the Unemployment Insurance Act in that they were either not registered with the UIF / failed to submit monthly declarations to the UIF / failed to make payments of contributions to the UIF; 
  • Failed to submit return of earnings for COIDA and outstanding monies owed to COIDA 

The consequences of the joint operations led to 3 people being arrested,  holding severe legal consequences for both entities with possible significant financial penalties which could be imposed.
